Court Discharges Robbery Suspect

A Maiduguri High Court judge, Justice Wakil Gana, on Tuesday discharged an armed robbery suspect, Tumba Tumba, after his alleged victims failed to recognise him during trial.
Tumba, 46, was arraigned before the court on a one-count charge of armed robbery, contrary to Section 298 of the Penal Code.
Mr Yunus Gazali, the prosecutor, had told the court that the Tumba had allegedly robbed two persons, Alhaji Yerima Ali and Alhaji Habibu Gambo, of their belongings in their house in Gamboru, Maiduguri.
Gazali said the accused, armed with a cutlass and a knife, broke into the residents of the complainants on Aug. 20, 2006, and robbed them of five GSM phones and N600,000 cash.
But the complainants and their witnesses failed to identify the accused as the robber who dispossessed them of their belongings.
In a judgment, Justice Gana discharged and acquitted the accused since the witnesses failed to identify him.
He also said that the accused had spent about seven years in prison custody, which was about two third of the sentence required by law for his crime, if he had been convicted. (NAN)
