Supreme Court Dismisses Bode Ola's Case Against Senator Ojudu


The Supreme Court earlier today dismissed the electoral case instituted by Bode Ola against Senator Babafemi Ojudu and the Action Congress of Nigeria (ACN), describing it as frivolous.
Mr. Bode Ola had instituted the case claiming that he was the actual winner of the ACN senatorial primaries. He had earlier lost at both the trial court and the Appeal Court.
Speaking on behalf of the other justices, Justice Tanko Mohammed of the Supreme Court said that the case was a non-starter and that processes and procedures were not adhered to.
Describing the case as that of fact and law, Justice Mohammed said Mr. Ola's counsel ought to have sought the relief of the court to file the appeal, but that the appeal was filed before the relief was sought, adding that the Supreme Court cannot be hoodwinked.
The justice added that the case was frivolous and that the Supreme Court would not get involved in frivolity. He wondered how the case got listed in the first instance, describing it as a waste of the court’s time.
Visibly angry, the justices also warned that on no account should the Supreme Court be reduced to a court of frivolities, saying that what they had before them was not an appeal, but a bunch of useless papers.
The court, however, stated that Mr. Ola's counsel, Olumide Ayeni, was not to blame as he merely led the sixth set of lawyers hired by Mr. Ola. The justices stressed that the case was bad through and through.
Mr. Ojudu's lawyer, Kayode Ajulo, thanked the court. He also noted that he incidentally learnt the principles that guided his conduct of the case from Mr. Ayeni, adding that he learned a lot when Mr. Ayeni was his principal at Afe Babalola Chambers.
Femi Falana represented ACN in the case.
The Supreme Court dismissed the case and awarded costs to Senator Ojudu and the two counsel.
